The FGTS balance accumulated over years of work in Brazil represents, for many expatriates, a forgotten resource in a dormant account. The most common perception is that definitive departure from the country automatically releases the withdrawal. It does not.
This guide clarifies which withdrawal scenarios really apply for FGTS withdrawal living abroad, how to use the balance as a down payment in purchasing a property in Brazil, the risks of Birthday Withdrawal for those living outside, and step-by-step through the FGTS App without needing to return to the country.
FGTS withdrawal living abroad: definitive departure is not an autonomous scenario
This is the most important information in this analysis, and the least known.
The Declaration of Definitive Departure from the Country (DSDP) or Communication of Definitive Departure does not appear in article 20 of Law 8.036/1990 as FGTS withdrawal scenarios. Definitive emigration, by itself, does not release the balance.
The Caixa Econômica Federal explicitly confirms on its overseas withdrawal page: “To be entitled to FGTS withdrawal, a worker residing abroad must fit one of the withdrawal scenarios provided in article 20 of Law No. 8.036/90.”

Which withdrawal scenarios apply for those living abroad?
The withdrawal scenarios in Art. 20 of Law 8.036/1990 most relevant for expatriates are:
- Dismissal without just cause (section I): the most direct reason. If you were dismissed before leaving, you can withdraw the full balance.
- Retirement through INSS (section III): valid even while living outside. The INSS issues a specific certificate for FGTS, PIS and PASEP withdrawal when it grants the retirement.
- Three consecutive years outside the FGTS Regime (section V): for those who left voluntarily (requested dismissal) and spent 36 consecutive months without any formal employment with a signed contract in Brazil.
- Linked account without deposits for 3 years (section XI): a specific account that receives no credits for 36 consecutive months, regardless of other employment relationships.
- Worker aged 70 or older: an autonomous age-based scenario.
Emigration may coincide with one of these scenarios without causing it. Example: you were dismissed without just cause in March, left Brazil in June. The withdrawal scenario is the dismissal, not the emigration.

I was dismissed without just cause. How do I withdraw while abroad?
Dismissal without just cause releases FGTS withdrawal regardless of where you are. Via the FGTS App (iOS and Android), without needing to go to Brazil, you:
- Access with CPF and registration data
- Select the corresponding withdrawal scenario
- Attach rescission documentation (CTPS or termination notice)
- Indicate a Brazilian bank account for receipt (or a trusted third party’s account)
- Await approval — credit within up to 15 business days
FGTS cannot be credited to an overseas bank account. If you do not have an account in Brazil, you can indicate a trusted third party’s account. The “Withdrawal for residents abroad” field in the App allows you to declare this situation.
I requested dismissal and left. When can I withdraw?
Those who requested dismissal do not have an immediate withdrawal scenario. The alternatives are:
Three years outside the FGTS Regime (Art. 20, V):
The count starts on the termination date of the last employment contract with FGTS contributions. Withdrawal becomes available starting in the birth month of the account holder, in the year when the 3-year period is completed — there is a temporal window tied to the birthday.
If you sign a new employment contract with a signed contract in Brazil before completing the 3 years, the count resets to zero.
Account without deposits for 3 years (Art. 20, XI):
A specific linked account that receives no credits for 36 consecutive months. ⚠️ VERIFY whether this scenario also has the withdrawal restriction tied to the birth month or whether withdrawal is immediate after 36 months.
Birthday Withdrawal abroad: possible, but with critical disadvantage
Birthday Withdrawal is possible for those living abroad. The option and annual withdrawal are done via the FGTS App without needing to return to Brazil. Every year, in your birth month, you withdraw part of the balance:

The critical disadvantage: by opting for Birthday Withdrawal, you lose the right to full withdrawal in case of dismissal without just cause. In case of rescission, you can only withdraw the 40% fine — the principal balance remains withheld until the next birthday. For those living abroad who may eventually return to the Brazilian labor market, this is a significant risk.
The Ministry of Labor pointed out in 2025 that 13 million workers had their balance locked by this modality, totaling R$ 6.5 billion withheld.
Rules for canceling Birthday Withdrawal (new rules as of November/2025):
- Cancellation can be requested via the FGTS App, remotely
- The return to the Rescission Withdrawal modality only takes effect starting on the 1st day of the 25th month after the request — that is, more than 2 years of waiting
- If there is an anticipated contract with a financial institution, cancellation may be unfeasible

How to use FGTS as a down payment when purchasing a property in Brazil
Even while living abroad, you can use your FGTS balance as a down payment or part of the payment in acquiring a residential property in Brazil, as long as you meet the requirements of Law 8.036/1990 and Caixa’s standards:
Main requirements:
- Have at least 3 years of work under the FGTS Regime (totaling all employment relationships)
- Not be an owner of residential property in the municipality where you intend to purchase, work or reside

How the transaction works:
FGTS enters as a complement to bank financing or as amortization of the down payment amount. The bank financing the property requests the release of funds directly from Caixa.
If you live abroad and want to use FGTS in purchasing a property in Florianópolis — for example, as a patrimonial asset or future residence upon return — it is necessary to coordinate the transaction with the financing bank and the administrator or real estate agent in Brazil. How to withdraw via the FGTS App while abroad: step-by-step
Since 01/02/2021, withdrawal for overseas residents is done exclusively via the FGTS App — consulates and embassies no longer process requests.
Necessary documents and information:
- CPF (mandatory — no alternative)
- Brazilian identity document or passport within validity period
- Documentation of the withdrawal reason (CTPS, retirement certificate, termination notice)
- Mobile number and e-mail for authentication
- Brazilian bank account number for receipt, or indication of a third party account
About the phone: initial App registration specifies a mobile with +55 code. ⚠️ VERIFY whether the App accepts a foreign number in initial registration or whether this requires an on-site proxy.
If you cannot access the App: constitute a proxy in Brazil via public power of attorney instrument (can be executed overseas, with apostille) with specific powers to regularize registration at a Caixa branch.

I have more than one FGTS account: can I withdraw from all?
Yes. When you qualify under a withdrawal scenario, it covers all linked accounts of the account holder — not just the most recent. The payment order is:
- First the accounts from terminated contracts, starting with the smallest balance
- Then the remaining accounts
In Birthday Withdrawal, the withdrawal percentage is calculated over the sum of all account balances of the account holder.

When does the 3-year count of an inactive account start?
The count starts on the termination date of the last employment relationship with FGTS contributions (contract rescission date). For the account-without-deposit-for-3-years scenario, it counts from the last credit recorded in that specific linked account. The count resets if you sign a new employment contract with a signed contract in Brazil before completing the 3 years. When interrupted, the count recommences from zero.
