This belief ranks among the most common misconceptions among those who have emigrated — and it can prove costly. Permanent departure from Brazil is not, in itself, a legal withdrawal ground. Permanent Departure Declaration does not automatically unlock FGTS withdrawal

The DSDP — Declaração de Saída Definitiva do País (Permanent Departure Declaration, or Comunicação de Saída Definitiva variant) — is a tax instrument. It notifies Receita Federal (Brazilian Federal Revenue Service) that the taxpayer is no longer a tax resident in Brazil. However, FGTS is governed by labor law, and these two systems do not automatically communicate with each other.

The Caixa Econômica Federal is direct in its overseas withdrawal guidance: “To qualify for FGTS withdrawal, a worker residing abroad must meet one of the withdrawal grounds specified in Article 20 of Law No. 8.036/90.” End of story. Emigration — with or without a Permanent Departure Declaration — does not appear as a standalone reason in that article.

What may occur is that departure from the country coincides with a valid withdrawal ground. Someone laid off without cause before leaving, for example, already has that right secured. Someone who resigned and has been without a formal employment link for over three years may qualify under another ground. But emigration itself is not the trigger.

Understanding this is the first step toward avoiding withdrawal attempts that will be rejected — and toward identifying which ground applies to your situation.


The five withdrawal grounds that work for those living abroad

Article 20 of Law 8.036/90 lists the conditions permitting FGTS access. For Brazilians residing abroad, five grounds are most applicable:

1. Dismissal without just cause (Article 20, I)
Anyone dismissed without just cause has the right to full balance withdrawal, regardless of location. This is the most straightforward ground and requires no additional waiting period. The withdrawal request period begins on the termination date and does not expire as long as funds remain in the account.

2. INSS Retirement (Article 20, III)
Retirement granted by INSS (Brazilian Social Security) unlocks FGTS even for those living outside Brazil. When retirement is granted, INSS issues a specific certificate authorizing FGTS, PIS, and PASEP withdrawal. This document is accepted in the FGTS App.

3. Three uninterrupted years outside the FGTS Regime (Article 20, V)
For those who resigned or left voluntarily: after 36 consecutive months without any employment link with FGTS contributions, withdrawal becomes available. There is a time condition: withdrawal can only be requested starting the holder’s birth month in the year when the 3 years are completed.

4. Linked account with no deposits for 3 years (Article 20, XI)
Different from the previous ground, this applies to a specific linked account that received no credits for 36 consecutive months — regardless of whether the worker has other active employment links.

5. Worker age 70 or older (Article 20, XIV)
Advanced age is a standalone ground, valid for any account holder regardless of employment exit type.

When any of these grounds applies, it covers all the account holder’s linked accounts — no need to request separately for each account. Payment order prioritizes accounts from terminated contracts, starting with the smallest balance.


Inactive account for 3 years: the ground most commonly used by expatriates

For those who left Brazil voluntarily — resigned, started a business, transferred via company relocation — Article 20, V typically applies. But it requires precise calculation.

The 3-year countdown begins on the termination date of the last formal employment contract with FGTS contributions. It is not the emigration date. If time passed between termination and departure, the clock was already running before leaving Brazil.

The countdown is continuous. If the worker signs any new formal employment contract in Brazil during this period, the counter resets and restarts from zero. Even a brief formal job of just a few months can delay withdrawal eligibility by another three years.

Another operational detail: withdrawal under Article 20, V only becomes available starting the holder’s birth month in the year when 3 years are completed. If 36 months expire in March but your birthday is in October, withdrawal cannot occur before October of that year.

For those with multiple employment histories across different linked accounts, verify each account separately. Article 20, XI (account with no deposits) may apply to specific accounts even if Article 20, V has not yet been satisfied for all accounts combined.


Birthday withdrawal while abroad: it is possible — but there is a caveat

Birthday withdrawal is available for those living abroad. Both enrollment and monthly withdrawal can be done via the FGTS App, with no need for physical presence in Brazil. The amount is calculated on the total balance across all accounts, with rates ranging from 50% (balances up to R$ 500) to 5% (balances above R$ 20 thousand), plus a fixed additional portion per bracket.

The problem lies in the disadvantage accompanying this mode: those who enroll in birthday withdrawal forfeit the right to full balance withdrawal in case of dismissal without just cause. If termination occurs, the account holder can only recover the 40% fine — the principal balance remains locked until the next birthday.

In 2025, the Ministry of Labor and Employment estimated that 13 million workers had balances blocked by this rule, totaling R$ 6.5 billion withheld. Provisional Measures 1.290/2025 and 1.331/2025 sought to mitigate specific cases of laid-off workers trapped in this situation.

For expatriates, the risk is amplified. Those living abroad often maintain the possibility of returning to the Brazilian labor market — and a dismissal without just cause in that scenario could result in accessing only the fine, with the principal balance locked.

Canceling birthday withdrawal takes time. The request to return to Dismissal Withdrawal mode can be filed via the FGTS App at any time, including remotely. But the effect materializes only on the first day of the 25th month after the request. In practice, over two years for the change to take effect. If an advance transaction is contracted with a financial institution, cancellation may be impossible while that operation remains active.

Starting November 2025, new rules limit this: new enrollees can only authorize balance inquiry after 90 days of enrollment, and starting November 2026 the limit drops to 3 withdrawals per year transferable or alienable (compared to up to 5 before).


How to withdraw FGTS via App while outside Brazil: step-by-step

Since February 1, 2021, FGTS withdrawal for those residing abroad is conducted exclusively via the FGTS App — available for iOS and Android. Consulates and embassies no longer process withdrawal requests.

What you need on hand:

  • CPF (required in all cases — no alternative)
  • Valid Brazilian identity document or passport within validity period
  • Documentation of withdrawal reason: employment record and termination notice (dismissal), INSS retirement certificate (INSS retirement), proof of time outside the regime (Article 20, V or XI)
  • Bank account at a Brazilian financial institution — or declaration of absence

The critical point regarding phone: The FGTS App requires, during initial registration, a mobile number with Brazilian country code (+55). Expatriates who transferred their Brazilian number to a local carrier, or never updated their registration, may face app access blocking. The App allows updating contact data within the application itself, but if initial access is already compromised, the solution requires appointing a proxy present in Brazil.

FGTS cannot be credited to an overseas account. This is a system limitation. Those without a Brazilian bank account have two alternatives:

  1. Designate a trusted third party’s account in Brazil (any bank accepted, including Caixa)
  2. Use the specific “Withdrawal for overseas residents” field in the App, which allows you to declare the absence of a Brazilian account and register a third party’s account for receipt

After documentation approval, credit occurs within up to 15 business days in the designated account.

If App access proves impossible: The account holder may appoint a proxy in Brazil via public power of attorney — which can be executed abroad, at a Brazilian consulate, or at a local notary with Hague Apostille certification. The proxy regularizes the registration at a Caixa branch with specific powers for this purpose.


Which withdrawal ground applies to someone who resigned and has lived abroad for less than 3 years?

Those who resigned and have not yet completed 36 months outside the FGTS Regime have no withdrawal ground available at this moment — except in two specific situations.

The first is INSS retirement, if you are approaching retirement eligibility criteria. The second is the inactive account ground (Article 20, XI): if a specific linked account received no credits for 36 consecutive months, it may be withdrawn even if the 3-year period under Article 20, V has not been reached for your full account set.
