Terrenos de marinha (“marine lands”) are 33-meter-wide strips measured from the 1831 high-tide line, running along coasts and navigable rivers. Full (allodial) ownership belongs to the Federal Government (União); properties built on this land are governed by a form of perpetual occupancy right (enfiteuse) — the occupant holds possession, but the União remains the underlying landowner.
When selling a property on terreno de marinha land, the buyer pays a laudêmio of 5% on the declared transaction value, in addition to keeping the annual foro fee current (0.6% of the assessed value registered with the SPU, the federal agency that manages these lands). In Florianópolis, properties in Jurerê Internacional, Lagoa da Conceição, Canasvieiras, and part of downtown sit on terrenos de marinha.
